4. Subscription Plans and Payments

SignalSpark offers multiple subscription tiers:

• Free Plan: 3 daily signals with basic features
• Premium Plan: $49/month - 15 daily signals with advanced features
• Elite Plan: $99/month - 50 daily signals with all features

4.2 Billing and Payments

Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method:

• Payments are processed securely through our payment providers
• All fees are non-refundable except as required by law or our refund policy
• Subscriptions automatically renew unless cancelled before the renewal date
• Price changes will be communicated 30 days in advance

4.3 Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers. To request a refund, contact support@cryptosignalhq.com within 7 days of your initial purchase. Refunds are not available for renewals or after the 7-day period.

5. Trading Signals and Investment Disclaimer

By using our Services, you acknowledge that you understand these risks and accept full responsibility for your trading decisions. SignalSpark is not liable for any losses incurred from following our signals.

6. Acceptable Use Policy

You agree not to:

• Use our Services for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Share, resell, or redistribute our signals without authorization
• Attempt to reverse engineer or copy our AI algorithms
• Use automated systems to scrape or collect data from our Services
• Interfere with or disrupt our Services or servers
• Impersonate any person or entity
• Transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Create multiple accounts to abuse free trial offers

7. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and AI algorithms, are the exclusive property of SignalSpark and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without our prior written consent.

8. API Usage Terms

For Premium and Elite subscribers with API access:

• API keys are personal and non-transferable
• You must comply with rate limits (100 req/min Premium, 500 req/min Elite)
• API access may be revoked for abuse or violation of Terms
• You are responsible for securing your API keys
• Commercial use requires explicit written permission
• We reserve the right to modify API functionality with notice

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIGNALSPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use our Services
• Trading losses incurred from following our signals
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on our Services
• Any other matter relating to our Services

Our total liability shall not exceed the amount you paid to SignalSpark in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SignalSpark, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our Services, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.

11. Dispute Resolution and Arbitration

Any dispute arising from these Terms or our Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association. The arbitrator's decision will be final and binding. You waive any right to a jury trial or to participate in a class action lawsuit.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice on our platform at least 30 days before the changes take effect. Your continued use of our Services after changes become effective constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
